We all know Kanye West knows how to get down but did the rapper steal a sample for his hit “Gold Digger”?

The lyrics “get down girl, go ‘head, get down” from his 2005 hit could arguably be one of the most iconic hooks in his stellar musical catalog but the family of David Pryor is claiming the rapper stole it.

According to TMZ, the Pryor family is suing West for copyright infringement of their father’s 1974 record “Bumpin’ Bus Stop.”

Daddy Pryor, who died in 2006, says “get down” in the song he performed with his group Thunder & Lightning. Now, his daughter and son, Trena Steward and Lorenzo Pryor, have filed a suit saying West lifted that sample to use it in his “Gold Digger” song as an echo to his own voice.

Defending the song, of which they both own one-quarter, the pair have asked a judge to stop the sale of the track and are suing for “millions of dollars” in damages for the unlicensed sample.

Additionally, they are claiming that West along with any other defendants named in the case has “systematically and willfully refused to clear samples of the plaintiffs’ original, copyrighted work in order to gain a commercial profit and to avoid paying and crediting the author.”

Others named in the suit are Roc-a-Fella Records, Bad Boy Records, Stones Throw Records, Bomb Hip-Hop Records, Autumn Games, Activision, Caroline Distribution and The Island Def Jam Music Group.

At the time of this report, West has not commented on the matter.
